Privacy Notice

We at CardEx respect our Users' right to privacy. This Privacy Notice (“Notice”) is an integral part of our Terms of Use, available on: http://cardex4business.com/terms and applies to Personal Data (as defined below) collected, uploaded, disclosed or processed via the App and/or Services. Any and all capitalized terms not defined herein shall have the meaning escribed to them in the Terms of Use.

If you choose to install the App on your device or provide us with any Personal Data, you agree to this Privacy Notice and CardEx's policies described herein. You may not install or use the App or the Services or provide, upload or share any Personal Data, to CardEx, through the App and/or Services, if you do not agree to any of the terms herein.

CardEx may, at any time and from time to time, modify this Notice. Modifications to this Notice will be posted on the App or CardEx's website, and shall be effective as of the date in which they are posted on the App or CardEx's website.

The Highlights

Information you choose to share on your Public Profile shall be shared with other Users and third parties on and outside the App. Use discretion when deciding what to share on the App. Any information you include in your Public Profile shall be considered as non-confidential. Once you make Personal Data public through the App, other Users and third parties may download such information, and you may be precluded from deleting or modifying the information downloaded by them. CARDEX WILL NOT BE LIABLE OR RESPONSIBLE FOR ANY DAMAGES IN CONNECTION WITH THE ABOVE.

You may choose to synchronize Public Profiles on the App with contacts lists on your device. If you choose to do so, we will access the contacts lists on your device to allow the synchronization. However, we will not collect information from your device regarding contacts which are not users on the App.

Our App and Services are intended for Users over the age of 16 or equivalent minimum age for providing consent to the processing of Personal Data in the relevant jurisdiction. Minors under such age are not permitted to install, register to or use the App or the Services. If you are under such age you should uninstall the App from your device and discontinue use of the Services.

The App is not intended for the disclosure or processing of Personal Data which is of a sensitive or confidential nature. Please do not use the App for such purpose.

You are prohibited from using the App in any way which is offensive, inappropriate or otherwise infringing upon another User or third party's rights. You are prohibited from impersonating any other User or person. CardEx makes no representations or warranties in connection with any information provided through the App and shall not be liable to any damages which may arise in connection with such information.

You may review and may be entitled to request to amend, erase or restrict the processing of your Personal Data, pursuant to applicable law. Please note that in case you request to erase or restrict the processing of your Personal Data, your use of the App and/or Services may be restricted or denied.

We may transfer your Personal Data outside the geographical region through which collection or access to the App and Services are made. By using the App and/or the Services, and accepting this Notice, you explicitly and unequivocally agree to such transfer.

We do not sell, trade, or rent Users' Personal Data to third parties. We only share Personal Data with third parties in connection with the provision of the App and/or Services to our Users, or other limited circumstances specified herein.

We do not conduct any automatic profiling of Users.

We are not responsible for the privacy practices or the content of third party websites, services and advertisements which may appear on the App, and you visit them or provide them with Personal Data at your own risk.

1. Collection and Use of Personal Data

The term “Personal Data”, when used in this Notice, means any information regarding an identified or identifiable natural person.

1.1 CardEx only collects and processes Personal Data which is provided to CardEx voluntarily by the User.

1.2 Personal Data and User Content are processed by CardEx for the following purposes:

1.2.1 For the provision of the App and the Services to Users, to communicate with Users regarding customer service issues, or to provide updates with respect to material changes or additions to this Notice and the Terms. We may also use Personal Data to respond to questions or comments, help us improve our products and services and to help resolve any problems.

1.2.2 To maintain, monitor and improve the App.

1.2.3 For the purpose of our legitimate interests, in accordance with applicable law.

1.2.4 To protect the security or integrity of our databases or the App, to take precautions against legal liability.

1.3 CardEx does not knowingly collect or process Personal Data included in Special Categories of Personal Data (as defined in Regulation (EU) 2016/679, the GDPR). In the event you become aware that Personal Data included in Special Categories of Personal Data has been collected or processed by CardEx, please inform us immediately.

2. Data Protection and Retention

2.1 Maintaining the security and integrity of Personal Data is important to us. We follow generally accepted industry standards as appropriate to protect Personal Data from unauthorized access, alteration, disclosure or destruction. However, no method of transmission or electronic storage is 100% secure. Therefore, while we strive to use appropriate means to protect Personal Data, we cannot guarantee its absolute security.

2.2 CardEx retains Personal Data for the duration necessary in order to: (i) fulfill the purposes of processing described herein, and (ii) defend or assert legal claims and liability, or as otherwise permitted under applicable law.

3. Users' Rights

3.1 You are entitled to review your Personal Data, and may exercise such right through your account on the App, or by sending us a request to: support@cardex4business.com. In the event any Personal Data is incorrect or outdated, you may update and correct such data by providing us with appropriate information. In the event CardEx refuses to amend any Personal Data, it shall notify User of the grounds for such refusal.

3.2 You may be entitled to request the erasure or restriction of processing of your Personal Data, and we will comply with such requests, to the extent required under applicable law. Please note that in the event you request to restrict the processing of Personal Data, we may not be able to provide you with some or all of the Services.

3.3 To the extent processing of Personal Data is conducted on the basis of your consent, you may rescind such consent at any time, by sending us an email to: support@cardex4business.com. Please note that in the event you rescind your consent to the processing of Personal Data, we may not be able to provide you with some or all of the Services.

3.4 You are entitled to lodge a complaint with the relevant supervisory authority in case you believe your rights to privacy and data protection have been violated.

4. Sharing of Data With Third Parties

4.1 We may share non-personal, aggregate or statistical information regarding the App and/or Services usage with our affiliates, partners and advertisers. From time to time, we may release non- personal information in the aggregate, e.g., by publishing a statistical report on trends in our App and/or Services usage.

4.2 Personal Data may be shared with third parties only under limited circumstances, as follows:

4.2.1 With trusted third parties who assist us in operating the App and Services, conducting our business, expanding our business or servicing you, and for personalizing your experience of the App, including by way of target advertising on the App.

4.2.2 To comply with a legal requirement, for the administration of justice, to protect your vital interests or the vital interests of another User, to protect the security or integrity of our databases or the App, to take precautions against legal liability, in the event of a breach by User of this Notice or the Terms, or in the event of a corporate sale, merger, reorganization, dissolution or similar event.

5. International Transfer of Personal Data

5.1 By using the App or the Services and communicating electronically with us, you explicitly and unequivocally consent to transfers of Personal Data as specified herein.

5.2 CardEx is a global enterprise and may maintain facilities and databases in different countries. We may, from time to time, transfer information, including Personal Data, to one of our databases in a country other than the country User is located in.

5.3 If the level of privacy protection in a country does not comply with recognized international standards, we will ensure that data transferred to our databases in that country is adequately protected and that the transfer of data to third parties in such country is made pursuant to a contract or other measures providing adequate protection, or otherwise implementing appropriate safeguards.
